1. Acceptance of Terms
These Terms of Service (“Terms”) form a binding agreement between you and Nora Skin Spa LLC, a North Carolina limited liability company (“Nora Skin Spa,” “we,” “us,” or “our”). They govern your access to and use of our website noraskinspa.com (the “Website”), our online booking system, our spa services, and any other products or services we provide (collectively, the “Services”).
By visiting our Website, booking an appointment, completing an intake form, purchasing a product or gift card, or otherwise using our Services, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the Services.
2. Eligibility
You must be at least 18 years old to book services or use the Website on your own. Clients ages 13 to 17 may receive services only with the express written consent of, and in the presence of, a parent or legal guardian who is also 18 or older. We do not provide services to children under 13. By using the Services, you represent that you meet these requirements and have the legal capacity to enter into these Terms.
3. Description of Services
Nora Skin Spa offers cosmetic skincare services, including facials, skin treatments, skin assessments, and related wellness services as described on our Website and in our service menu. Service availability, pricing, duration, providers, and inclusions may change without notice. We reserve the right to refuse, modify, or discontinue any service at any time, in our sole discretion, when we determine in good faith that doing so is in the interest of client safety, provider safety, or business operations.
4. Appointments and Bookings
4.1 How to Book
You may book appointments through our Website, our online scheduling system, by phone at (919) 244-2787, by email at wellness@noraskinspa.com, or in person. A booking is confirmed only after you receive a confirmation message from us or our scheduling system.
4.2 Information Accuracy
You agree to provide accurate, current, and complete information when booking, including any required intake or health information. You are responsible for keeping your contact information up to date.
4.3 Arrival Time
Please arrive at least 10 minutes before your scheduled appointment to allow time for check-in and intake review. If you arrive late, your service may be shortened to accommodate the next client, and the full service price will still apply. If you are more than 15 minutes late, we may need to reschedule your appointment and apply our late-cancellation/no-show policy.
5. Cancellation, Reschedule, and No-Show Policy
Because spa services are reserved exclusively for you, late cancellations and no-shows directly affect our team and other clients. The following policy applies unless we communicate otherwise in writing:
• Cancellations and reschedules made at least 24 hours before the appointment are free of charge.
• Cancellations or reschedules made less than 24 hours before the appointment may be subject to a fee of up to 50% of the service price.
• No-shows (failure to arrive without notice) may be charged up to 100% of the service price.
• Repeated late cancellations or no-shows may result in a requirement to prepay for future appointments or the loss of booking privileges.
By providing a payment method at the time of booking, you authorize us to charge applicable cancellation, no-show, or late fees to that payment method.
6. Deposits
Some services, packages, or peak-time bookings may require a deposit at the time of booking. Deposits are applied to the cost of the service. If you cancel or reschedule outside of our cancellation window, the deposit will generally be refunded or transferred. If you cancel within the cancellation window or no-show, the deposit may be retained as a cancellation fee, in accordance with Section 5.
7. Payment, Pricing, and Taxes
Service prices are listed on our Website, in our service menu, or as quoted at the time of booking. We accept payment methods identified on our Website or at our front desk. Prices are exclusive of applicable sales taxes, which will be added where required by law. Gratuity for service providers is appreciated but not required.
You authorize us to charge your selected payment method for booked services, products, deposits, and any applicable cancellation, no-show, or late fees. If a payment method is declined, we may require an alternate method before providing services.
8. Refunds and Service Adjustments
Because spa services are personal and rendered upon completion, we generally do not offer refunds for completed services. However:
• If you are unsatisfied with a service, please notify us within 7 days of the appointment so we can discuss adjustments.
• Retail products may be returned unopened, in original packaging, within 14 days of purchase, with proof of purchase. Opened products are non-refundable for sanitary reasons unless they are defective.
• Pre-paid packages and series are non-refundable except where required by law, but unused services may be transferred to other clients with our written approval.
• Gift cards are non-refundable, are not redeemable for cash (except where required by law), and do not expire except as permitted by applicable law.
9. Memberships, Packages, and Promotions
Memberships, packages, and promotional offers are subject to the specific terms communicated at the time of purchase or sign-up, including any term length, auto-renewal, cancellation procedure, and benefit limitations. Promotional offers may not be combined unless we expressly say so. We reserve the right to modify or terminate any promotion at any time. Where applicable, North Carolina’s Health Spa Act may apply to certain prepaid contracts; we will provide any required disclosures and rights of cancellation.
10. Client Intake, Informed Consent, and Health Disclosure
Before certain services, you may be asked to complete an intake form and a written informed-consent document, and to disclose information about your health, medications, allergies, and skin conditions. You agree to provide accurate and complete information. Failure to disclose accurate information may increase the risk of an adverse reaction and may release Nora Skin Spa from liability for harm that could have been avoided with accurate disclosure.
You agree to immediately inform your service provider of any pain, discomfort, allergic reaction, or change in condition during a service.
11. Treatment Risks; No Medical Advice
Spa services may carry risks, including but not limited to skin irritation, redness, breakouts, allergic reactions, sensitivity, dryness, hyperpigmentation, and similar reactions. We will explain reasonably foreseeable risks before performing services for which informed consent is required, but no list of risks can be exhaustive.
Our services and any information provided through the Website are for general cosmetic and informational purposes only. We are not a medical provider, and our services and content do not constitute medical advice, diagnosis, or treatment. You should consult a qualified healthcare professional for any medical concern. Do not delay or disregard medical advice based on anything you receive from us.
12. Pregnancy and Medical Conditions
If you are pregnant, nursing, taking prescription medications (including but not limited to retinoids, isotretinoin, blood thinners, or photosensitizing drugs), have recently undergone a medical or cosmetic procedure, or have any medical condition affecting your skin, you must inform us before booking and again at check-in. We may decline or modify services at our discretion to protect your safety.
13. Spa Etiquette and Client Conduct
To maintain a safe and welcoming environment, you agree to:
• Treat staff and other clients with courtesy and respect.
• Refrain from harassment, intimidation, abusive language, or threatening behavior.
• Refrain from intoxication on the premises and from bringing alcohol, drugs, or weapons into the spa.
• Silence mobile devices and respect quiet areas.
• Follow all posted policies and the reasonable instructions of our staff.
We reserve the right to refuse service, end a service in progress, or remove any person from our premises for violating these Terms or for any conduct we determine is unsafe, unlawful, or inappropriate. Service charges may still apply in such cases.
14. Personal Belongings
You are responsible for your personal items. Nora Skin Spa is not liable for loss, damage, or theft of any personal property brought to or left at our premises. Please leave valuables at home.
15. Photographs and Media Releases
We may take “before and after” treatment-planning photos with your written consent for clinical purposes. Separately, we may request your written consent to use photos, videos, or testimonials in marketing or social media. Use of any client image in marketing requires your express, written, voluntary release. You may revoke a marketing release at any time by contacting us; revocation is prospective and does not require us to remove already-printed materials.
16. Communications and Marketing Consent
By providing your email address or phone number, you consent to receive transactional communications related to your appointments, account, and Services (including booking confirmations, reminders, follow-up care, and policy updates). With your separate consent, we may also send marketing emails and text messages, in accordance with the CAN-SPAM Act, the Telephone Consumer Protection Act (TCPA), and applicable state law. You may opt out of marketing emails by clicking the unsubscribe link, and out of marketing text messages by replying STOP. Standard message and data rates may apply. Opting out of marketing will not stop transactional messages necessary for the Services.
17. Website and Intellectual Property
All content on the Website — including text, graphics, photos, logos, designs, trademarks, service marks, layouts, and the “Nora Skin Spa” name — is owned by or licensed to Nora Skin Spa LLC and is protected by U.S. and international intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Website for personal, non-commercial purposes. Except as expressly permitted, you may not:
• Copy, reproduce, modify, distribute, publish, display, or create derivative works from any part of the Website.
• Use any robot, scraper, or automated means to access the Website.
• Reverse engineer, disassemble, or attempt to extract the source code of the Website.
• Remove or obscure any copyright, trademark, or other proprietary notices.
• Use the Website for any unlawful purpose or in any way that could harm the Website, our clients, or our business.
18. User Submissions and Reviews
If you submit reviews, comments, photos, suggestions, or other content (“Submissions”) to us or to our public-facing channels (such as Google reviews referencing Nora Skin Spa), you grant us a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, sublicensable license to use, reproduce, adapt, publish, translate, and distribute the Submission in any media, with attribution where reasonable. You represent that your Submission is original, accurate, lawful, and does not infringe anyone’s rights. We may, but are not required to, monitor or remove Submissions at our discretion. Honest reviews are always welcome and protected by law (including the federal Consumer Review Fairness Act).
19. Third-Party Services and Links
The Services may rely on or link to third-party platforms (e.g., booking software, payment processors, analytics, social media). We are not responsible for the content, products, services, or practices of any third party. Your use of third-party services is governed by their own terms and policies.
20. Disclaimers
EXCEPT AS EXPRESSLY PROVIDED IN THESE TERMS, THE SERVICES AND THE WEBSITE ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY OF INFORMATION.
WE DO NOT WARRANT THAT THE SERVICES WILL ACHIEVE ANY PARTICULAR COSMETIC RESULT, THAT THE WEBSITE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT THE WEBSITE OR SERVERS THAT MAKE IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. INDIVIDUAL RESULTS VARY.
21. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, NORA SKIN SPA LLC AND ITS OWNERS, MEMBERS, MANAGERS, EMPLOYEES, AGENTS, AND AFFILIATES (THE “NORA PARTIES”) WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, LOSS OF GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH THE SERVICES, THE WEBSITE, OR THESE TERMS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE EXTENT LIABILITY CANNOT BE EXCLUDED, THE TOTAL AGGREGATE LIABILITY OF THE NORA PARTIES TO YOU FOR ALL CLAIMS RELATED TO THE SERVICES, THE WEBSITE, OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO NORA SKIN SPA IN THE 6 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US$100). NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED BY LAW (INCLUDING, FOR EXAMPLE, GROSS NEGLIGENCE OR WILLFUL MISCONDUCT).
22. Indemnification
You agree to indemnify, defend, and hold harmless the Nora Parties from and against any claims, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use or misuse of the Services or the Website; (b) your breach of these Terms; (c) your violation of any law or rights of any third party; (d) any inaccurate or incomplete information you provide to us; or (e) any content you submit to us or publicly post about us.
23. Assumption of Risk
You acknowledge that participation in spa services involves inherent risks, including but not limited to those described in Section 11. By receiving services after our explanation of foreseeable risks and after providing your informed consent, you voluntarily assume those risks to the extent permitted by law.
24. Privacy
Your use of the Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. The Privacy Policy is available on our Website.
25. Force Majeure
We are not responsible for any delay or failure to perform any obligation under these Terms due to events beyond our reasonable control, including acts of God, severe weather, power outages, internet or telecommunications failures, illness, public health emergencies, government actions, labor disputes, or supply-chain disruptions. We will make reasonable efforts to reschedule affected appointments.
26. Governing Law and Venue
These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-laws principles. Any dispute arising out of or related to these Terms or the Services that is not resolved informally shall be brought exclusively in the state or federal courts located in Wake County, North Carolina, and you and we consent to the personal jurisdiction and venue of those courts. Either party may pursue qualifying claims in small-claims court in Wake County. To the fullest extent permitted by law, you and we each waive any right to a jury trial.
27. Informal Dispute Resolution
Before filing a lawsuit, you agree to first contact us in writing at wellness@noraskinspa.com and provide a brief description of the dispute and your contact information. We will use good-faith efforts to resolve the dispute within 30 days of receiving your notice. This informal-resolution requirement does not apply to claims that may proceed in small-claims court or to applications for emergency injunctive relief.
28. Termination
We may suspend or terminate your access to the Services at any time, with or without notice, for conduct that we determine in good faith violates these Terms or harms our team, our clients, or our business. Sections that by their nature should survive termination (including ownership, disclaimers, limitation of liability, indemnification, governing law, and dispute resolution) will survive.
29. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will revise the “Last Updated” date and, where appropriate, provide additional notice (such as posting a notice on our Website). Your continued use of the Services after the effective date of the revised Terms constitutes acceptance of the changes.
30. Miscellaneous
• Entire agreement: These Terms, together with our Privacy Policy and any service-specific terms, constitute the entire agreement between you and Nora Skin Spa LLC regarding the Services.
• Severability: If any provision is held unenforceable, the remaining provisions remain in full force and effect.
• No waiver: Our failure to enforce any right or provision is not a waiver of that right or provision.
• Assignment: You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, financing, or sale of assets.
• No agency: No agency, partnership, joint venture, or employment relationship is created by these Terms.
